Signing a new executive order, President Trump has instructed the EPA to review the "Waters of the United States" rule using a narrower definition of waterway and with an eye to economic impacts. The original rule used a wider definition of waterway and did not include an economic test. The process of review, and possible repeal, could take months or years and will be challenged in court. A weaker rule will benefit any energy operator with operations, roads or facilities nearby flowing or intermittent streams.
