Wood Mackenzie Supply Chain Intelligence Platform (SCIP) Privacy Statement

As used herein, “Wood Mackenzie Supply Chain” or “we” refers to Wood Mackenzie Limited’s Affiliate, Power Advocate, Inc.  An “Affiliate” of an entity shall mean a legal entity that is Controlled By or that is under common Control with such entity; wherein “Controlled By” or ”Control” means holding more than 50% of the voting power or ownership interests or having possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of such entity.  Wood Mackenzie Supply Chain respects your concerns about privacy. This Wood Mackenzie Supply Chain Intelligence Platform Privacy Notice (the “Notice”) applies to any personal data we collect  as a result of the operation and management of the suite of web-based technology offerings known as the Wood Mackenzie® Supply Chain Intelligence Platform™ (formerly, the PowerAdvocate® Energy Intelligence Platform®) (the “Solutions”) that is accessed from woodmac.com  (the “SCIP Site”) by Buyer Companies and Supplier Companies, as those terms are defined in the Wood Mackenzie Supply Chain Intelligence Platform Terms of Use (the “Terms of Use”) found at .  Buyer Companies and Supplier Companies are collectively “Participating Companies”.  Individual users of the Solutions, from both Buyer Companies and Supplier Companies, may be referred to individually and collectively as “you” and “your” in this Notice.  The Notice describes the types of personal data we obtain, how we use the personal data, and with whom we share it. We also describe the rights you may have and how you can contact us about our privacy practices.

This Notice does not apply to personal data provided to Wood Mackenzie Supply Chain with requests for information regarding Wood Mackenzie Supply Chain products and services through our marketing channels, such as on the public access portion of woodmac.com  (the “Site”) and on CostInsights.com, ESGData.com, public webinars provided by Wood Mackenzie Supply Chain, and Wood Mackenzie Supply Chain marketing events.  This Notice also does not apply to personal information submitted to Wood Mackenzie Supply Chain on the Site as part of an application for employment at Wood Mackenzie.  Personal information provided to Wood Mackenzie Supply Chain for these purposes is subject to the Privacy Statement.

With respect to Buyer Companies that have written agreements with Wood Mackenzie Supply Chain, this Notice is applicable to their Users, or, if there is no written agreement between Wood Mackenzie Supply Chain and the Buyer Company this Notice complements the Wood Mackenzie Supply Chain Intelligence Platform Terms of Use.  With respect to Suppliers, this Notice complements the Wood Mackenzie Supply Chain Intelligence Platform Terms of Use.  Except as described herein, Participating Companies using the Solutions are the data controllers for their respective users’ personal data, and Wood Mackenzie Supply Chain is the data processor.  Participating Companies are responsible for making sure that any required consents are granted before entering personal data in the Solutions, and for providing necessary disclosures regarding data collection and use by third parties.

1. How We Obtain Information About You

We may collect your personal data that you choose to provide to us through the Site or otherwise, including, but not limited to, your first and last name, employer, title, business physical address, business e-mail address, business telephone number (which may be a mobile phone number used for business), such as when you:

  • Register for access to the Supply Chain Intelligence Platform;
  • Fill out a form, datasheet, questionnaire or survey within the Solutions;
  • Upload a document with such information within the solutions; or
  • Submit a request for support services (for example, by sending us an email to support@Poweradvocate.com).

When you use the Solutions, we also may collect certain information by automated means using technologies such as cookies, non-cookie-based tokens, web server logs, tracking pixels, and web beacons. Cookies are files that websites send to your computer or other Internet-connected device to identify your browser uniquely or to store information or settings in your browser. Your browser may tell you when you receive certain types of cookies and how to restrict or disable certain cookies. Please note, however, that without cookies, you may not be able to use all of the features of the Solutions. Non-cookie-based tokens are encoded URL-based identifiers that track e-mail click-thru activity or time-sensitive password reset keys and will work in scenarios where cookies are disabled, or a session has not been initiated.

We may also collect personal data in other contexts that we will notify you of at the time.

2. Information We Obtain

Information That You Provide to Us

Personal data that you provide directly to us will be apparent from the context in which you provide it, for example:

  • If you fill out a registration form, you will generally provide your name, business contact details and any other information requested by the form, such as the reason for your submission or, in the case of Suppliers, your organization’s products and/or services; or
  • In conjunction with your Participating Company’s use of the Solutions, you may provide personal data through responding to forms, questionnaires, surveys, (referred to as “Forms”), or in communications initiated within the Solutions between users within a Buyer Company or between users of a Buyer Company and a Suppler Company.

Each form on our Site varies in the information required and collected. In most cases, an asterisk (*) indicates the required information on a form. You may choose to provide additional information within fields that are not required.

When we collect personal data during the registration process on the Supply Chain Intelligence Platform, we do not request home physical addresses, home or personal telephone numbers, or personal email addresses; rather, we request business contact information only.  Wood Mackenzie Supply Chain does not request and you should not provide non-business contact information or sensitive personal information, such as your personal financial account information, your medical or insurance information, your government-issued identification, passport or license information, your family information, or any other non-business personal information (collectively “Sensitive Personal Information”).

Information That We Collect Automatically

Our web servers may log information such as your operating system type, browser type, domain, and other system settings, as well as the language your system uses and the country and time zone where your device is located. The web server logs may also record information such as the address of the web page that referred you to our Sites and the IP address of the device you use to connect to the Internet. They may also log information about your interaction with the Sites, such as which pages you visit. To control which web servers collect information by automated means, we may place tags called “web beacons” — small files that link web pages to particular web servers and their cookies. We may also collect information from your browser, such as your browsing history while using the Solutions, and use it in conjunction with data gathered from forms and e-mails to help us understand and respond to your needs.

“Do Not Track” Signals

Your browser settings may allow you to transmit a “Do Not Track” signal to websites and online services you visit. Like many other websites and online services, we do not currently process or respond to “Do Not Track” signals from your browser or to other mechanisms that enable choice. Both we and others (such as our service providers) may collect personal data about users’ online activities over time and across third-party websites.

Information That We Obtain From Third Parties

Buyer Companies may provide us with the personal information of their authorized users of the Solutions, limited to the user’s name, business email, employer, business phone number, title and, for users of some Buyer Companies, employee ID number. 

3. How We Use Information That We Obtain

Information That You Provide to Us

Wood Mackenzie Supply Chain may be actively involved in the Solutions in many ways, including by on-boarding new Users for Buyer companies, providing training to users, assisting a Buyer Company with the preparation and posting of a request to Supplier Companies for proposals on Sourcing Intelligence, by promoting Supplier Company participation, and by facilitating Participating Company use of the Supply Chain Intelligence Platform through helpdesk services and other support services, and we may use personal data that you provide to us in carrying out those activities.  We may also use personal data that you provide to us to provide announcements about products and future events, conduct surveys, and contact you for other reasons related to offering and improving our services.  We use the personal data for these purposes because we have a legitimate business interest in providing services to our Buyer customers and to Supplier Companies that is not overridden by your interests, rights and freedoms to protect personal data about you.  

In addition to the uses discussed above, we may also use the personal data you provide on our Site to:

  • operate, evaluate, and improve the Solutions;
  • develop new products and services;
  • assist our customers;
  • perform market research;
  • administer the Solutions and the SCIP Site.

We use the personal data for the purposes described above, in which we are the controller of the personal data, because we have a legitimate interest in operating and improving our business that is not overridden by your interests, rights and freedoms to protect personal data about you.

We may also use the information to comply with or enforce applicable legal requirements, industry standards, and our policies and terms.  We use personal data for these purposes when it is necessary to protect, exercise or defend our legal rights, or when we are required to do so by law that applies to us.

Information That We Collect Automatically

We use personal data that we collect automatically through cookies, non-cookie-based tokens, web beacons, and other automated means for purposes such as customizing and enhancing users’ visits to the SCIP Site, facilitating use of the Solutions, collecting statistics about your usage of the Solutions, and understanding the manner in which users use the Solutions. We also use the information to help diagnose technical and service problems, administer the SCIP Site, and identify users of the Solutions. We use clickstream data to determine how much time users spend on web pages of the Solutions, how users navigate through the Solutions, and how we may tailor the Solutions to meet the needs of its users. We use the personal data for the purposes described above, in which we are the controller of the personal data, because we have a legitimate interest in operating and improving the Solutions that is not overridden by your interests, rights and freedoms to protect personal data about you.

We also use third-party web analytic services on the SCIP Site, such as those of Google Analytics. The service providers that administer those services may use cookies and web beacons to help us analyze how users use the Site. The information collected by the cookies and web beacons (including your IP address) is available to the service providers, which use the information to evaluate your use of the Site.

Other Uses of Information

In addition to the uses described above, we may use personal data that you provide to us or that we collect for other purposes.  Where that is the case, we will provide an additional privacy notice to you that describes the purposes for which we will use the personal data and our legal basis for doing so.

4. Information We Share

We do not sell or otherwise disclose personal data that you provide to us or that we collect on our Site, except as described here. We may share personal data you provide to us or that we collect on the Site with:

  • Other Wood Mackenzie Supply Chain Affiliates; and
  • Service providers that perform services on our behalf.

We may share personal data with our Affiliates for a number of reasons, including because you have requested information about our Affiliates’ products and services.

If you register as a user of the Solutions for a Supplier Company, your personal data, i.e., the business contact information that you submit as a contact person for that Supplier Company, is included in the company profile of your Supplier Company, which is then included in Wood Mackenzie Supply Chain’s searchable directory of Suppliers.  We may share Supplier company profiles with Buyer companies and other customers of Wood Mackenzie Supply Chain in the course of providing advisory services; the searchable Supplier directory may also be accessed by Buyer companies using Sourcing Intelligence, Supply Market Intelligence, Contract Intelligence and Supplier Intelligence.  This is a service to our clients that also provides a benefit to Supplier Companies by connecting Supplier Companies with potential customers for their goods and services.  Wood Mackenzie Supply Chain is the Data Controller with respect to these services, however, any Buyer Company that accesses your company’s Supplier Company profile becomes the data controller for the personal data in the Supplier profile.

We may share personal data with service providers that perform services on our behalf, such as hosting providers and advisers.  All such service providers have entered into legally binding agreements requiring them to use or disclose personal data only as necessary to perform services on our behalf and to comply with applicable legal requirements.

In addition, we may disclose personal data about you (a) if we are required or permitted to do so by law or legal process, for example due to a court order or a request from a law enforcement agency, (b) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, (c) in connection with an investigation of suspected or actual fraudulent or other illegal activity, and (c) in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution, or liquidation).

5. Data Transfers

We may transfer the personal data that we collect about you to recipients in countries other than the country in which the personal data originally was collected. Those countries may not have the same data protection laws as the country in which you initially provided the personal data. When we transfer your personal data to recipients in other countries (such as the United States), we will protect that personal data as described in this Notice.

If you are located in the UK, European Economic Area (“EEA”) or Switzerland, we will comply with applicable legal requirements providing adequate protection for the transfer of personal data to recipients in countries outside of the UK, EEA and Switzerland.  In all such cases, we will only transfer your personal data if:

6. How Long We Keep Information

The time period for which we keep personal data depends on the purpose for which we collected it.  In all cases we keep it for as long as necessary to fulfill the purposes for which we collected it.  We will then delete the personal data, unless we are legally required to retain it or if we need to retain it in order to comply with our legal obligations (for example, for tax and accounting purposes).

Subject to any applicable legal requirements, we typically retain personal data as follows:

  • Personal data you provide to us through or in support of the Solutions (and that are not covered by the following bullets): we keep for as long as necessary in order to fulfil our contractual obligations to our Buyer customers, to comply with laws and regulation, and to exercise our contractual rights for legitimate business purposes.
  • Personal data collected solely for analytics purposes: we keep this personal data for a short period of time necessary for us to carry out the analytics.
  • Website logs: we keep Site audit logs, which may contain your personal data, for as long as necessary to fulfil the purpose for which it was collected.

7. Your Rights and Choices

If you are a registered user of the Solutions for a Buyer Company, the Buyer Company is the data controller and you should submit requests and inquiries about your personal data to the Buyer Company.

If you are a registered user of the Solutions for a Supplier Company, you may change the personal data in the Supplier profile.

If you are located in the UK, EEA or Switzerland, you may have the following rights in relation to personal data that we hold about you:

  • To request confirmation of whether we process personal data relating to you, and if so, to request a copy of that personal data;
  • To request that we rectify or update your personal data that is inaccurate, incomplete or outdated.
  • To request that we erase your personal data in certain circumstances, such as where we collected personal data on the basis of your consent and you withdraw your consent;
  • To request that we restrict the use of your personal data in certain circumstances, such as while we consider another request that you have submitted, for example a request that we update your personal data;
  • Where you have given us consent to process your personal data, to withdraw your consent; and
  • To request that we provide a copy of your personal data to you in a structured, commonly used and machine readable format in certain circumstances.

8. Updates to Our Online Privacy Notice

We may update this Notice periodically and without prior notice to you to reflect changes in our personal data practices or relevant laws. We will post the updated version and indicate at the top of the notice when it was most recently updated.
