FTC denies Peabody/Arch Joint Venture – what does it mean for the coal industry?

Tuesday 29 September US District Judge Sarah E Pitlyk issued a preliminary injunction on the proposed joint venture between Peabody and Arch coal. Judge Pitlyk wrote that the US Federal Trade Commission (FTC) “has shown that there is reasonable probability that the proposed joint venture will substantially impair competition in the market for southern Powder River basin coal.” Arch has announced that they will withdraw from the proposed joint venture.
