On 19 June 2019, the US EPA finalised the Affordable Clean Energy (ACE) Rule and repealed the 2015 Clean Power Plan (CPP). The Rule identifies "inside the fenceline" heat rate improvements (HRI, also called "efficiency improvements") as the Best System of Emission Reductions (BSER) for existing steam generating fossil fuel-fired EGUs. It also updates the implementing regulations for this and all future emission guidelines promulgated under CAA section 111(d). A companion proposal to relax New Source Review (NSR) permit requirements for sources when they undertake efficiency improvements is being prepared but has not been finalised at this time.
